Conditions of sale

1. Scope

The following terms and conditions apply to all orders placed via our online shop by consumers or traders.

Consumer means an individual acting for purposes which are wholly or mainly outside that individual’s trade, business, craft or profession;

Trader means a person acting for purposes relating to that person’s trade, business, craft or profession, whether acting personally or through another person acting in the trader’s name or on the trader’s behalf.

These terms also apply to traders for future commercial relations without the need for any formal expression thereof. Unless expressly approved by us to the contrary, we cannot accept the contractual validity of any conflicting or complementary general terms and conditions used by any trader.

2. Contractual partner, formation of contract

The purchase contract is concluded with company DAUNENSTEP AG with registered office in Auna, Hauptstraße 7, 39054 (BZ), REA n. BZ85218, VAT. Nr. 00533740213.

The pictures, which represent the products are used for illustrative purposes. Any differences between the pictures and the products themselves are minor and do not affect the essential characteristics of the products. The color of the products on the online-shop may differ slightly from the actual product color, as it depends on the type of the Internet browser and the monitor used.

The display of products within the online shop constitutes a binding offer on our part to enter into a contract vis-à-vis the items. You may place our products in your basket without obligation and amend your entries at any time prior to submitting a binding order by using the correction facilities that are provided for this purpose and explained during the ordering process. The contract is formed by clicking on the order button which indicates your acceptance of our offer concerning the goods contained in your basket. Once you have sent your order you will immediately receive a confirmation via e-mail.

We reserve the right to not confirm an order for any reason; This may occur if one of the ordered products is not available, if there is ambiguity with the received order (for example: illegible document) or if there occured an unforeseen problem with the delivery. We are going to contact you in any case and inform him about the incident. Furthermore, there cannot be made an order, if a previous order has not been paid yet.

 

3. Contract language, Saving of the contract text

The language available for concluding the contract is Italian.

We save the text of the contract and forward the order data and our T&Cs to you by e-mail. The text of the contract cannot be accessed via the internet for security reasons.

 

4. Prices

All the prices of the products, which are present on the website are expressed in Euro and include already the VAT. You accept the fact that we have the right to change prices at any time, since the goods are invoiced with those prices, which result on the website at the time of ordering and at the time of receiving the confirmation, which is sent to you via mail.

 

5. Delivery conditions

We are engaged to deliver the ordered goods after receipt of the payment. If you pay by bank transfer, the delivery period starts from receipt of the payment. If an item is not on stock at the time of order, you are going to be informed immediately or we will offer a similar substitute.

We only dispatch goods en route; pick up by the customer is possible only in Italy at our local dealer network. We do not deliver to post boxes.

Shipping costs

The delivery cost for orders up to 149,99€ amounts to € 9,00 (incl. VAT.), all orders which exceed this amount, the transport is for free. The transport costs will be added to the amount of the order. 

Delivery area

We are delivering to the following countries:Italy, Austria, Belgium, Denmark, Estonia, Finland, France, Germany, Greece, Iceland, Latvia, Liechtenstein, Lithuania, Luxembourg, Netherlands, Poland, Portugal, Czech Republic, San Marino, Slovakia, Slovenia, Spain, Sweden, Hungary. If your country is not on the list, please contact us, we will try to find a solution. 

Purchases by customers from Switzerland: 

We do not deliver to Switzerland. Swiss customers can refer to the MeinEinkauf.ch service. 

How does it work: 

mekRegister at meineinkauf.ch. During the purchase process on our website, please indicate the shipping address that you obtain when registrering at MeinEinkauf.ch (MeinEinkauf GmbH, Maybachstrasse 19, 78467 Konstanz, Germany). 6. Payment

Cash in advance (Bank transfer)

We must receive payment in advance before your order can be processed and the goods can be dispatched, unless we have agreed otherwise in advance in writing.

 

Cash on Delivery (Only in Italy)

For the payment cash on delivery we charge 6€. This method of payment is offered only in Italy and only for orders below 1999 €. 

 

Credit Card

With the submission of the order, you are sending us your credit card details at the same time. After your identification as the legal cardholder, directly after the order, we will ask your credit card company to initiate the payment transaction. The payment transaction is automatically carried out by the credit card company and charged to your card.

 

PayPal

During the ordering process you will be forwarded to PayPal's online website. To pay the invoice amount via PayPal, you must be registered there or register first, identify yourself with your access data and confirm the payment instructions to us. After submitting your order in the shop we instruct PayPal to initiate the payment transaction.

Directly afterwards, the payment transaction is carried out automatically by PayPal. You will receive additional information during the ordering process.

 

Payment at pickup

You are paying the amount due directly when you pick up the purchased goods at the chosen point of sale. The payment means are defined by the relative dealer. 

 

7. Damage during delivery

For consumer the following applies: If the goods are delivered with obvious damage caused during delivery, please report the defect to the carrier and notify us without delay. Failure to make a complaint or to make contact does not in any way affect your legal rights or the enforcement of such rights, notably your warranty rights. However, in doing so you help us to assert our own claims against the carrier or transport insurer.

 

8. Warranty and guarantees

We are under a legal duty to supply products that are in conformity with this contract. Statutory warranty rights apply. Information on any additional guarantees and their precise conditions that may apply can be found next to the product or on distinct information pages in the online shop, if applicable.

For all down comforters and quilts DAUNENSTEP provides an additional warranty of 8 years, which leads to a total of 10 years warranty. More information can be found here.

 

9. Responsibility

DAUNENSTEP assumes no liability for incidents which have been caused by major force or unforeseeable circumstances or incidents which are due to a malfunction or breakdown of the Internet, which make it impossible, to carry out the order within the stipulated and agreed time as from the contract.

 

10. Online dispute resolution

The European Commission provides a platform for online dispute resolutions (ODR) which can be accessed at http://ec.europa.eu/consumers/odr/. We are ready to participate in extra-judicial dispute settlement proceedings before a consumer dispute resolution body. The competent body is: Verbraucherzentrale Südtriol (VZS) – Onlineschlichter.it, Zwölfmalgreinerstr. 2, 39100 Bozen (BZ), Italy.

 

11. Completeness

These conditions of sales are made of all the single clauses of which they consist. Should one or more of terms be invalid or be declared as invalid by the law or according to a regulation or due to a decision by a competent court, the remaining conditions shall remain in force.

The entire content of the website www.daunenstep.com and all related second-level websites are owned by Daunenstep and therefore protected. None of these contents may be modified, copied or distributed by means of electronic systems without written permission of Daunenstep. All rights reserved.

 

12. Applicable law and competent jurisdiction

These conditions of sale are subject to Italian law. All disputes which can not be settled by a consensual solution, fall exclusively in the competence of the jurisdiction of the court, where the CUSTOMER is resident, as long as they are within the state.
