Conditions of sale
1. General Conditions
These conditions apply between the company DAUNENSTEP AG with registered office in Auna, Hauptstraße 7, 39054 (BZ), REA n. BZ85218, VAT. Nr. 00533740213, hereinafter described as ''DAUNENSTEP'' and each person who purchases online on the website www.daunenstep.it, described in the following as "CUSTOMER". These conditions are subject to change, as the date of settlement corresponds to the date when it came into force.
2. General Sales Conditions
At the moment of sending the order, the CUSTOMER has confirmed to have read and accepted the general conditions and terms without reservation. The full acceptance of the Terms and Conditions is made concrete by the CUSTOMER by sending the order and its confirmation.
The CUSTOMER places the order after ticking the field "I accept the sales conditions". The system of automatic registration of DAUNENSTEP is considered to be the proof of the nature, the content and the date of the order.
4. Order Confirmation
The order is considered complete once the CUSTOMER of DAUNENSTEP receives an email with the order confirmation. The e-mail contains the data of the CUSTOMER and the details of the order, the price of the purchased goods, the transport costs and the address to which the goods are sent. The CUSTOMER is obliged to check the data and to notify desired corrections immediately.
DAUNENSTEP reserves the right to not confirm an order for any reason; This may occur if one of the ordered products is not available, if there is ambiguity with the received order (for example: illegible document) or if there occured an unforeseen problem with the delivery. DAUNENSTEP is going to contact the CUSTOMER in any case and inform him about the incident. Furthermore, there can not be made an order, if a previous order has not been paid yet.
5. Delivery conditions
DAUNENSTEP is engaged to deliver the ordered goods within ten working days after receipt of the payment (credit card and Paypal). When the CUSTOMER pays by bank transfer, this delivery period starts from receipt of the payment. If an item is not on stock at the time of order, the CUSTOMER is going to be informed immediately or DAUNENSTEP will offer a similar substitute.
6. Transport costs
The delivery cost for orders up to 149,99€ amounts to € 9.00 (incl. VAT.), all orders which exceed this amount, the transport is for free. The transport costs will be added to the amount of the order. For each order, which arrives through the Online Shop (www.daunenstep.it), the CUSTOMER will receive the receipt via email. When creating the receipt, it will be used the data, that was indicated during the purchase process by the CUSTOMER. After the receipt has been created, it is no longer possible to alter the receipt.
7. Delivery Partner
The delivery is made by the courier BARTOLINI during the usual office hours. It is asked to provide a delivery address and a reachable phone number, in order that the package can be delivered without any problems.
All the prices of the products, which are present on the website www.daunenstep.com are expressed in Euro and include already the VAT.The CUSTOMER accepts the fact that DAUNENSTEP has the right to change prices at any time, since the goods are invoiced with those prices, which result on the website at the time of ordering and at the time of receiving the confirmation, which is sent to the CLIENT via mail.
9. Tecnical sheets of the products
The pictures, which represent the products are used for illustrative purposes. Any differences between the pictures and the products themselves are minor and do not affect the essential characteristics of the products. The color of the products on the online-shop may differ slightly from the actual product color, as it depends on the type of the Internet browser and the monitor used by the CUSTOMER.
10. Payment Conditions
Any payment made by the CUSTOMER can only be done by Credit Card, by Paypal or bank transfer. The communication regarding the payment and the information provided by the CUSTOMER will be kept confidential and covered with all the guarantees, which are provided by the security protocols of the payment networks.
11. Right of withdrawal
Consistent with the applicable provisions of law, the CUSTOMER has the right to resign form the sales contract within 14 days, without specifying the reason for doing so. The right to resign expires after 14 days, starting from the date on which the CUSTOMER has acquired the physical possession of the goods. Excluded from the right of return are customized products, that can not be found as a standard product on the website www.daunenstep.it.
To exercise the right of return, the CUSTOMER is obliged to inform DAUNENSTEP (Hauptstraße 7, 39054 Auna / Renon (BZ), Tel: +39 0471 359 600, Fax: +39 0471 359 633, email: email@example.com) about his decision to revoke from the contract by letter, fax or electronic mail. To meet the deadline to resign, it is sufficient if the communication is made before the withdrawal period.
Consequences of the withdrawal
In case of withdrawing from the the sale contract, any payment which has been made in connection with the order (transport costs included) are going to be refunded within 14 days after DAUNENSTEP has been informed abouth the wish from the CUSTOMER to resign.
The reimbursement of the amount is carried out by the same payment method, with which the order was made except the CUSTOMER stated explicitly the desire to receive the refund in a different payment method. In any case, the CUSTOMER has no costs of this refund.
The reimbursement can be put on hold until the effective receipt of the returned goods or until the receipt of a delivery confirmation from the CUSTOMER, that the products have been returned; whichever occurs first.The CUSTOMER is asked to return the products to this address: DAUNENSTEP SpA - Via Aldo Moro 9 / A - 38062 San Giorgio - Arco (TN) and to return them in any case within 14 days after the announcement to revoke from the purchase agreement. The cost of returning the goods are payed by the CUSTOMER. The goods have to be returned complete, in all its entirety and in its original packaging (including packaging and any documentation and accessories). The products that are returned may not be used, washed or damaged.
12. Legal Conformity law
In the case the CUSTOMER receives products which do not correspond to the order or in case they are defective, the CUSTOMER is obliged by Art. 132 of the consumer codex to communicate this via email to the customer service of DAUNENSTEP (firstname.lastname@example.org) within 2 months after observing this non-conformity.
13. Product Warranty
All products on the website www.daunenstep.com have a warranty of 24 months in case of conformity defects, in accordance with applicable laws. To take advantage of the warranty, the CUSTOMER must keep the purchase receipt. For all down comforters and quilts DAUNENSTEP provides an additional warranty of 8 years, which leads to a total of 10 years warranty. More information can be found here.
DAUNENSTEP assumes no liability for incidents which have been caused by major force or unforeseeable circumstances or incidents which are due to a malfunction or breakdown of the Internet, which make it impossible, to carry out the order within the stipulated and agreed time as from the contract.
The entire content of the website www.daunenstep.it and all related second-level websites are owned by DAUNENSTEP and therefore protected. None of these contents may be modified, copied or distributed by means of electronic systems without written permission of DAUNENSTEP. All rights reserved.
These conditions of sales are made of all the single clauses of which they consist. Should one or more of terms be invalid or be declared as invalid by the law or according to a regulation or due to a decision by a competent court, the remaining conditions shall remain in force.
17. Applicable law and competent jurisdiction
These conditions of sale are subject to Italian law. All disputes which can not be settled by a consensual solution, fall exclusively in the competence of the jurisdiction of the court, where the CUSTOMER is resident, as long as they are within the state.
